1. Agreement to these terms

By accessing or using this website, you agree to these Terms of Service. If you do not agree, do not use the website or public demonstration. If you use the website for a company or dealership, you represent that you are authorized to act for that organization.

2. Website and walkthrough requests

The website provides information about BDC Evolution and lets business representatives request a product walkthrough. Submitting a request does not create a customer account, guarantee service, or form a subscription agreement. Any purchase or use of the BDC Evolution application requires the applicable dealership agreement, pricing terms, and setup approval.

3. Public demonstration

The public demonstration uses synthetic sample information and is provided only to evaluate the product experience. You may not attempt to bypass demonstration restrictions, introduce real customer information, send communications, access another system or account, interfere with the service, or use automated means to scrape or overload it.

4. Acceptable use

You may not use the website to violate law, infringe another person’s rights, distribute malicious code, probe for vulnerabilities without written authorization, submit false or harmful information, impersonate another person, or disrupt website operation. We may limit or block access when reasonably necessary to protect the website, visitors, or BDC Evolution.

5. Intellectual property

BDC Evolution LLC and its licensors own the website, demonstration, software, design, text, graphics, trademarks, and other content, except where identified otherwise. We grant you a limited, revocable, nonexclusive right to access the public website for legitimate business evaluation. No other license is granted.

6. Third-party services and links

The website may link to third-party services. BDC Evolution does not control and is not responsible for third-party content, availability, security, or privacy practices. A link does not imply endorsement.

7. Informational content and availability

Website descriptions are general information and may change as the product evolves. Specific customer functionality, pricing, and obligations are determined by signed dealership documents. We may modify, suspend, or discontinue public website or demonstration features at any time.

8. Disclaimers

To the fullest extent permitted by law, the public website and demonstration are provided “as is” and “as available.” BDC Evolution disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not promise uninterrupted or error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, BDC Evolution LLC and its officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the public website or demonstration. BDC Evolution’s total liability arising from public website use will not exceed one hundred U.S. dollars. These limits do not apply where prohibited by law.

10. Governing law and venue

These terms are governed by Ohio law, without regard to conflict-of-law principles. Any legal action concerning the public website or these terms must be brought in a state or federal court with jurisdiction in Summit County, Ohio, unless applicable law requires otherwise.

11. Changes and severability

We may update these terms by posting a revised version and changing the date above. Continued website use after the effective date constitutes acceptance of the revised terms. If any provision is unenforceable, the remaining provisions remain in effect.
